Contest Summary Description: KidVid Contest Powered by Commonwealth Edison Company (“ComEd” or “Sponsor”) is a competition for fifth grade elementary school students. Students are asked to select one of four different ComEd categories from which to create a 30 to 50 second video of their own creation that best represents what their chosen category means to them. The video from each category will be posted to the ComEd YouTube page, YouTube.com/CommonwealthEdison for a popular vote where people may vote by clicking “Like”. The video from each category that receives the most “Like” votes will appear on the ComEd website for one month in 2018. The winning students of each video will each receive a $50 prize gift card, a group Power Up VIP Party at their school, and their school, or one designated school if the winning students are home-schooled, will receive a $2,500 donation. Contest Sponsor: KidVid Contest Powered by ComEd is sponsored by Commonwealth Edison Company, 1919 Swift Drive, Oakbrook, IL.
Contest Submission Period: The contest submission period runs from September 25, 2017 through November 10, 2017 (“Contest Period”). All student/classroom video submissions with accompanying consent forms must be received no later than 11:59:59 p.m., October 27, 2017. Consent forms will be available online by September 13, 2017. Each student(s) and/or group that submits a video by October 6th, 2017 meeting the eligibility requirements as indicated below (“Early Entry”), will receive a portable power charger. Eligibility: Fifth grade students and their schools to the extent they are affiliated with any schools, located within ComEd’s service area, are eligible to participate; fifth grade students not affiliated with any school or homeschooled may also participate. Multiple teams within a school may each submit a video, however there can only be one team winner per school. How to Enter: In order for students to participate, students’ parents/guardians must complete and sign permission forms for each participating child and submit them with their video. Each school will be responsible for collecting and retaining the originals of all their students’ permission forms and submitting electronic copies of them to ComEd at KidVid Contest Powered by ComEd, P.O. Box 4927, Oak Brook, IL 60523, via email to KidVidContest@ComEd.com or through ComEd.com/KidVidContest. Early Contest Entry: Each Early Entry will each receive a portable charger for each participating student of that Early Entry. The Sponsor will determine the make and model of the portable charger. Participation in the Early Entry submission and/or receipt of a portable charger will not influence any decision by the Sponsor as to the Contest award. The Sponsor will determine, in its sole discretion, whether or not the submission meets the criteria for an Early Entry. Requirements of Entries: Contest Entries will be disqualified if they contain, as determined in the sole discretion of the Sponsor, any content that:
- includes the depiction of unsafe electricity practices, including but not limited to, touching or coming close to electric wires, even if it is a prop.
- includes anyone not in fifth grade in on-camera roles.
- contains any personal identification, such as license plate numbers, personal names, email addresses or street addresses;
- depicts any individuals in the video other than the students who are eligible to participate and have had their parents or legal guardian’s sign and execute the waiver and release provided by Sponsor;
- defames or invades the publicity rights or privacy of any person, living or deceased, or otherwise infringes upon any person’s personal or proprietary rights;
- is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
- promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous, including without limitation activities involving electricity; promotes any particular political agenda or message;
- is obscene or offensive; endorses any form of hate or hate group;
- defames, misrepresents or contains disparaging remarks about other people or companies, including ComEd;
- contains copyrighted materials owned by others (including, without limitation, music, cartoons, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without written permission in form satisfactory to Sponsor;
- communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
- violates any law.
- Is otherwise deemed inappropriate for public display or inconsistent with the intent and purpose of this Contest, as may be determined by ComEd in its sole and exclusive discretion.
By submitting a Contest Entry, each participant (and his/her parents or legal guardians) acknowledges and agrees that his/her/their Contest Entry may be posted on ComEd’s website and its social media sites, and other Sponsor websites during and following the Contest and voted on by the public. ComEd is not responsible for any unauthorized use of Contest Entries by third parties. ComEd does not guarantee the posting of any Contest Entry and Sponsor may remove a posted Contest Entry at any time or for any reason, in its sole discretion.
By participating in the Contest and submitting a video, each participating student (and his/her parents or legal guardians) represents and warrants 1) that the work submitted is original (except for instrumental music, sheet music as well as materials and/or any elements owned by Sponsor, that participating students are permitted to use for the purposes of this Contest), 2) that it complies with these Official Rules, 3) that the video has not been previously published, 4) that the video does not infringe the intellectual property rights of any other party, and 5) that the video has not won any previous awards. In addition, by submitting a Contest Entry, the participating students’ parent(s) or legal guardian(s) warrant and represent that he/she consents to the submission and use of the Contest Entry in the Contest and to its use as otherwise set forth in these Official Rules. Participants and their Parents/Guardians acknowledge and agree that Sponsor may receive other Contest Entries under this Contest that may be similar or identical to the Contest Entry submitted by other participants, and waive any and all claims he/she/they may have had, may have, and/or may have in the future, that any other Contest Entry reviewed and/or used by Sponsor may be similar to his/her Contest Entry. Contest Category Descriptions: ComEd has established four different categories that help promote knowledge and awareness of 1) storm response and power reliability, 2) ComEd in the community, 3) electrical safety and 4) energy efficiency. Students may choose among these categories for their submissions and are encouraged to check out ComEd’s website for more information:
1. Lights ON! ComEd is improving the energy grid to keep the lights on throughout the areas we serve, such as: at home, school, hospitals and amusement parks. Our crews with their big trucks work hard to repair downed power lines from fallen trees. These crews work through rain, wind, storms and snow so we all can enjoy the great things electricity provides. ComEd’s Community Care Vans deliver aid to neighborhoods impacted by especially bad storms by providing mobile internet hotspots, pcs/smart device charging stations, batteries, water and ice to help customers “weather the storm.” Smart meter technology can also notify ComEd when your power goes out and when your power is restored. This means we can respond to outages quicker and more efficiently. Using your creative and acting powers, create a video that shows (1) how smart meter technology helps to keep the lights on, (2) ComEd crews working hard to repair the overhead and underground energy grid or (3) ComEd’s Community Care Van in action.
2.ComEd in the Community There are a number of cool things ComEd does to keep in touch with you and support the community. For example, we also deliver nutritional and delicious tree trimmings to the animals at Brookfield Zoo; plant trees, restore neighborhood parks and encourage neighborhood gardening; promote education in Science, Technology, Engineering and Math education (Icebox Derby & After School Matters); contribute to local arts and culture; participate in neighborhood parades with the ComEd float and Louie the Lightning Bug; attend local festivals to answer your questions and so much more. Create a video on programs and events ComEd is involved with, and how you and your family enjoy them. 3. Power Protectors Energy is so readily available that most people may take it for granted. This is why it is important to remember to be respectful and careful around it. Here are a few electrical-safety tips especially for kids: Outlets: Don’t ever stick anything but an electrical plug into an electrical outlet. Keep Dry: Never touch anything electrical if you’re wet or standing in water. Play Safe: Never fly kites, model airplanes or balloons near power lines. No Climbing: Don’t play on or around utility poles, trees near power lines or ComEd electrical boxes. Fallen Lines: If you see a fallen power line: STAY AWAY. Create a video of your team’s favorite Electrical-Safety tip.
4. It’s so Easy being GREEN Some people think “being green” means driving an electric car or growing a garden full or vegetables you can eat. Others think it means planting trees to improve our environment. Some use solar panels to produce energy for their home or business. But being green is as easy as conserving air conditioning in the summer and heat in the winter, recycling an old refrigerator, using LED light bulbs, turning the lights off when not needed, or calling the ComEd pros for a free energy check-up of your home. Create a video with tips that make it easy to be green. Video Guidelines:- Must include fifth grade students from schools or home schooled for on-camera roles.
- Must be between 30 seconds and 50 seconds in length.
- Must be 100 megabytes or less in size.
- Must be uploaded in horizontal (not vertical) format. If filming with a phone or iPad, the entrant will need to turn the device sideways. Files must be .MP4/MPEG4 or .MOV. It is recommended that the video is HD 16:9 ratio and 15Mbit/sec.
- Will include an adult contact for your video, who can be a teacher or administrator from the submitting school.
- Don’t depict unsafe practices, especially related to electricity or downed wires.
- Don’t depict the effects of electrical injury or accident by touching wires or coming in contact with wires.
- Video can’t contain any personal identification, such as license plate numbers, personal names, email addresses or street addresses.
Submission Review, Judging and Voting: Beginning October 28, 2017 an interdepartmental team of ComEd personnel will review all submissions and select the best three videos submitted for each of the four categories (resulting in 12 videos in total). ComEd’s decisions regarding these selections are final and at its sole discretion. The videos determined to be the best in each of the four categories will be posted on ComEd’s YouTube page YouTube.com/ComEd. Voting will ensue for a period of two weeks where people may vote for their favorite video in each four categories; there will be one vote per person per category. Voting will end Friday, November 10, 2017 by midnight.
The video from each category that receives the most votes will appear on the ComEd website for an entire month in 2018. The schedule of these posts will be announced and provided after all winners have been determined.
The winning submissions in each category will receive a $50 prize and VIP party. Also, the school which the student attends or designates if home schooled, will earn a $2,500 prize. Winners will be announced via ComEd.com and its social media sites on or after December 1, 2017 and awards will be presented at school rallies in December 2017 and January 2018. Individual participants, without their school participation will be notified directly at the contact phone number provided on the consent form. ComEd reserves the right to modify the timing of this voting schedule.
Prize Acceptance: Prizes are not transferable, assignable or partially awardable. No substitution will be allowed except by exclusive decision of ComEd. All taxes, including federal, state and local taxes, are the sole responsibility of each winner who may be issued an IRS 1099 tax form (winners are advised to seek independent tax advice regarding prize winnings). Winners will be contacted via phone and email and must respond in the affirmative via phone, phone messaging or email message, as provided in the notification, within three (3) days of notification in order to be identified as a winner and receive a prize. Parents/guardians of student winners and their respective school officials (as applicable) are required to sign and return an Affidavit of Eligibility (“Affidavit”) and Agreement of Publicity and Release of Liability (“Agreement”) within seven (7) days of their winning notification, or deliver the Affidavit to the ComEd photographer who will take their photo for promotional marketing communications and other uses. The Agreement gives ComEd the right to use the winners’ names, likenesses and cities of residence in any and all winner announcements in all media channels. If a potential winner cannot be contacted within three (3) days after the first attempt to contact the potential winner, or if the potential winner chooses not to accept the prize, or if the potential winner does not sign and return the Affidavit and Agreement in the required time period, the prize will be deemed forfeited and an alternate winner may be selected by ComEd at its discretion.
Odds of Winning: Since contest winners are decided by popular vote, the odds of winning cannot be reliably calculated.
General: By participating, each participant agrees: (a) to abide by these Official Rules and decisions of the Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless ComEd and its respective officers, directors, shareholders, affiliates, employees, agents and representatives, including the judges of the foregoing, (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from participant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, voice, performance, Contest Entry, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from participant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.
Conditions: ComEd and its agents are not responsible for any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Contest; computer, online, or technical malfunctions; delays or human errors that occur in the processing, transmission or receipt of entries, or delays caused by computer transmissions; or any injury or damage to persons or property, including but not limited to entrants’ computers, hardware and/or software, which may be caused directly, or indirectly, in whole or in part, from entrants’ participation in the Contest, or receipt of any prize.
If, for any reason, the Contest is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures or other causes beyond the control of ComEd, ComEd reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. ComEd also reserves the right, in its sole discretion, to disqualify any individual or entity found to be violating these Official Rules or suspected of attempting to disrupt or defraud the entry process or the operation of the Contest, and ComEd may prosecute or seek other legal redress against anyone suspected of engaging in these acts. ComEd is not responsible for lost, late, illegible, incomplete, invalid, misdirected, mutilated, technically corrupted or garbled entries (which will be disqualified) or for problems of any kind whether mechanical, human or electronic.
Copyright and Use of Submissions: All submitted pictures, illustrations or videos must be the original content of the submitting student and must not include or infringe upon any property, design, trademark, logo, artwork or other element owned by another copyright holder. Participants further agree that all material they submit for the Contest is owned by the student and/or the student’s parent or family or by the submitter, and that the submission is hereby licensed to ComEd without limitations or further compensation, including the right to display the pictures, illustrations or videos in any media now existing or yet to be invented. Submitter waives any right of publicity, attribution and integrity, including any moral rights in the picture.
Miscellaneous: Released Parties are not responsible for late, lost, damaged, inaccurate, delayed, garbled, misdirected, incomplete, undeliverable, destroyed or stolen Contest Entries, videos, or votes; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Contest Entries, the tabulation of votes, the cancellation or postponement of any dates set forth in the Official Rules of prize presentation, the announcement of the prizes, or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the any website used in connection with this Contest. Persons who tamper with or abuse any aspect of the Contest or any website (including the Promotion Website), who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Contest Entries will be void. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS” FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Contest Entries, or if Contest is unable to run as planned for any other reason, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, determine the potential winners from all eligible, non-suspect Contest Entries received for the Contest.
Arbitration: Except where prohibited by law, as a condition of participating in this Contest, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any awards provided, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and participant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois, USA.
